    Bylaws of the Retired Members Division of OPSEU

    By-Laws of the Retired Members Division of OPSEU/SEFPO

    As approved by President JP Hornick

     

    ARTICLE 1

    This OPSEU/SEFPO Division shall be known as the Retired Members Division of the Ontario Public Service Employees Union/ Syndicat des employés de la fonction publique de l’Ontario (OPSEU/SEFPO).

     

    ARTICLE 2  

    The purpose of this division is to:

    2.1            Bring together retired members to discuss common issues;

    2.2            Organize and sign up membership to retired members;

    2.3            Formulate recommendations for self-help or for action by the Union;

    2.4                    Advance the common interest of members of   this Division;

    2.5            Assist active OPSEU/SEFPO members to prepare for retirement;

    2.6           Foster ties with other labour organizations;

    2.7            Support OPSEU/SEFPO locals and other unions in their activism.

    • The Demand setting process:
    • Include a submission from the Retired Members Division;

    2.8.2 Two (2) representatives of the Provincial Executive of the Retired Members Division be invited to make a presentation at the training session of the elected members of the central bargaining team, and;

    2.8.3 The demand setting team sends a report to the Executive of the Retired Members Division once the employer has set out its bargaining position”.

     2.9           Inform members that they may remain on the Union’s mailing list for   whatever publications they wish to receive.

    2.10         Keep OPSEU/SEFPO informed of the concerns of retired members of this Division.

    2.11          Help members to improve pensions, housing, medical and health care, drugs and other consumer services.

     

    ARTICLE 3  

    The Division may seek affiliation with other organizations that have similar purposes, subject to the approval of the OPSEU/SEFPO President.

     

    ARTICLE 4  

    Membership in the Division is open to all OPSEU/SEFPO and Civil Service Association of Ontario (CSAO) members and employees of the union who leave the work force by retiring directly to a pension earned in their workplace or retiring from a bargaining unit with no pension plan upon payment of dues as approved by the Union.

    4.1       In order to be a member of the Retired Members Division you must submit a one-time lifetime payment of $10.00 to OPSEU/SEFPO or encourage your local to honour their retiring members with a payment.

     

    ARTICLE 5  

    5.1       Every paid-up retired member is entitled to:

                5.1.1 Be nominated for office in the Division, subject to the Constitution.

                5.1.2 Participate in the elections of the Division.

                5.1.3 Hold office in the Division.

                5.1.4 Attend any open meeting of the OPSEU/SEFPO Executive Board;

                 5.1.5 Receive updated copies of the Constitution and By-Laws and be advised of any amendments;

                5.1.6 Receive relevant publications.

    5.2     Every member will be eligible to participate, with voice but no vote, in the activities of an OPSEU/SEFPO Local in accordance with the Constitution.

     

    ARTICLE 6    

    The structure of the Division shall consist of seven regions and a Divisional Executive Committee (DEC).

     

    ARTICLE 7    

    Each region shall elect a Regional Executive Committee (REC) consisting of:

    • A Chair
    • A Vice-Chair
    • A Secretary
    • A Treasurer
    • Up to 4 Regional Executive Members-at-large.

    7.1   The number of Regional Executive Committee meetings per year shall be no more than 2 per year with minimal costs by exercising virtual, email and telephone where possible.

    7.2  A member of the Retired Members Division may attend the Regional Retired Members meetings, but can only vote, run for office or claim expenses for attending meetings in the region in which they reside.

    7.3   Regional elections for their Regional Executive Committee members can only be run by OPSEU/SEFPO Executive Board Members (EBMs) or OPSEU/SEFPO Staff. If there is another designated member selected to run the elections, this person cannot vote.

    7.4   Any member running for a position on the Regional Executive Committee is entitled to a scrutineer, if requested.

     

    ARTICLE 8

    8.1              The Chair of the REC shall preside at all REC and regional meetings, generally to supervise the affairs and operations of their region and carry out other duties as may be designated by the REC;

    8.2              The Vice-Chair shall perform all the Chair’s functions during their absence and carry out other duties as may be designated by the REC;

    8.3              The Secretary shall keep minutes for all meetings, distribute notices to all members as required and forward all pertinent membership information to OPSEU/SEFPO Head Office;

    8.4              The Treasurer shall be responsible for keeping and maintaining correct and proper accounts, making disbursements in accordance with the Constitution, and providing an update of expenditures at their REC meetings.

    8.5              The Chair or an elected/designated member shall attend meetings related to collective bargaining where permitted by OPSEU/SEFPO policy.

    8.6              The REC Members-at-Large may be assigned responsibility over one or more committees.

    8.7              A quorum of the REC shall be 50% of its eligible voting members.

    8.8              The Officers of each region shall be elected within 60 days of the close of the OPSEU/SEFPO annual Convention in every second year.

    8.9              All vacancies of Officers between elections shall be filled by election at the next regular regional meeting, unless within 3 months of the expiry of the term of office and at that point the Chair may fill the vacancy by appointment.

    8.10            The term for office for the DEC and REC shall be for 2 years.

     

    ARTICLE 9

    9.1              The Chairs of each region shall form the Divisional Executive Committee (DEC).

    9.2              They shall elect from this group:

    • A Chair
    • A Vice-Chair
    • A Secretary

    The remaining members of the DEC shall be known as Members-at-Large.

    9.3              The DEC shall elect from their group a member to sit on an applicable Negotiating Team for Employee Benefits, with voice but no vote, should the union agree.

    9.4              The DEC shall elect from their group a member to sit on an applicable Pension Board, when permitted.

    9.5              The DEC shall prepare policies and strategies for consideration and possible action by the membership. The DEC is also responsible for the implementation of all resolutions passed at Regional meetings and for the management of the affairs of the Division between Regional meetings.

    9.6              Meetings of the DEC are called by the Chair, who is also responsible for the preparation of the Agenda. The DEC shall also meet at the request of at least three of its members.

    9.7              A quorum of the DEC shall be 50% of its eligible voting members.

     

    ARTICLE 10

    10.1        The Chair shall preside at DEC meetings, generally supervise the affairs and the operation of the Division and carry out such other duties as may be designated by the DEC.

    10.2        The Vice-Chair shall perform all the Chair’s functions during their absence and accept and carry out such other duties as may be designated by the DEC.

    10.3        The Secretary shall keep minutes, distribute notices to all members as required and forward all pertinent membership information to OPSEU/SEFPO Head Office.

    10.4        The DEC shall, with the help of OPSEU/SEFPO Staff, prepare information material to be sent to members and shall prepare membership campaigns to bring within the membership activism with non-active retirees.

    10.5        The DEC and/or Regional Chair may, with OPSEU/SEFPO Staff, prepare retirement seminars or programs for use in the Region.

     

    ARTICLE 11

    11.1        Each region shall hold two regional meetings per year.

    11.2        The Order of Business, with the exception of items 5 & 7, shall be as listed in Article 29.7.2 of the Constitution.

    11.3        The Regional Chair may call a meeting at any time by giving at least fourteen days’ notice of the time and place and by sending the Agenda to the members at least seven days before the meeting date.

    11.4        The REC may call a special meeting by giving at least seven days’ notice (time and place and specific items to be considered). No additional items may be added to the agenda for a special meeting.

    11.5        The Secretary shall call a special meeting within fourteen days of receiving a written petition signed by at least 20% of the members and stating the purpose of the meeting.

    11.6        Meetings of the DEC shall be convened at the call of the Chair at least every six months.

     

    ARTICLE 12

    12.1        The election of Officers shall be by secret ballot and in accordance with Article 29.4 of the Constitution. The Officers shall be elected by majority vote and shall serve for a period of two years.

    12.2        Mid-term vacancies shall be filled promptly by election in accordance with Article 29.4.2 of the Constitution.

     

    ARTICLE 13

    13.1        Each Region may establish committees, with terms of reference.

    13.2        A quorum for all committee meetings shall be 50% of the eligible voting members of the committee.

    13.3        In the event of expenditures by the Regional Executive Committees, all such expenditures must be approved by the Division Executive Committee.

     

    ARTICLE 14

    14.1      The financial year of the Division shall correspond with the financial year of OPSEU/SEFPO.

    14.2      No Officer or member of the Division shall receive remuneration for duties performed on behalf of the Division, but these persons may be reimbursed for reasonable expenses incurred while performing these duties.

    14.3      The DEC shall prepare and submit to OPSEU/SEFPO an annual Retired Members Division Workplan and Budget Submission for the following year.

     

    ARTICLE 15

    15.1      It is the responsibility of each region of the Retired Members Division to minimize costs wherever possible, both for the sake of limiting expenditures as well as making sure that all regions are treated fairly.

    15.2      At the Regional General meetings, mileage will only be paid up to the distance to the nearest regional office or place of meeting. Use of electronic/virtual meetings and/or separate meetings in different geographical areas in each region is encouraged.

    15.3      Meal costs at Regional Retired Members meetings will be minimized where possible. Catering or negotiating a reduced restaurant rate to be paid by the Chair, who will then submit his/her claim to Member Claims at OPSEU/SEFPO Head Office.

     

    ARTICLE 16

    16.1      RULES OF ORDER for meetings shall be as set forth in Robert’s Rules of Order and Garfield Jones’ Parliamentary Procedure at a Glance.

     

    ARTICLE 17

    17.1    Proposals to amend these Bylaws may be submitted by any Region of this Division.

    17.2    In order to be considered by the DEC, submitted amendments must be accompanied by minutes indicating a two thirds majority vote of members in attendance clearly identifying and supporting the amendment.

    17.3    Reasonable notice will be given of any bylaw amendments to all members through the regular contact network informing of an upcoming meeting with the proposed amendment change by the Regional representatives on the DEC.

    17.4    Amendments will require a two thirds majority vote of all members present in all the regions to pass.

    17.5    Any amendments that meet these requirements are subject to the final approval by the President of OPSEU/SEFPO.

    OPSEU/SEFPO Rainbow Alliance Arc-en-Ciel affirms our solidarity with Capital Pride, which is facing cowardly and undeserved backlash for expressing principled solidarity with the international Palestinian community. We are looking forward to attending Capital Pride in Ottawa this weekend — and we look forward to celebrating with all OPSEU/SEFPO members and the broader community in attendance!

    As members of the 2SLGBTQIA+ community within OPSEU/SEFPO, we cannot stay silent when solidarity becomes conditional. Silence has never protected us. We will not stay silent when bad political actors with harmful agendas capitalize on the violence in Gaza to encourage the rise of hate.

    Capital Pride rightfully points to the characterization of Palestinians as homophobic and transphobic and Israel as affirming and tolerant — otherwise known as “pink-washing” — as a racist framing which advances hate. It also undermines solidarity and promotes Islamophobic violence.

    After nearly a year of witnessing unimaginable atrocities committed against the people of Gaza, rejecting to uphold such violence is not a controversial position. As affirmed in our expression of Solidarity with Palestine: A 2SLGBTQUIA+ Perspective, we recognize that the plight of the Palestinian people is deeply connected to our shared struggles against oppression and marginalization.

    Stop blaming front line correctional staff who work under impossible conditions: OPSEU/SEFPO statement on ICIT deployment at Maplehurst Correctional Complex

    TORONTO – OPSEU/SEFPO leaders are speaking out in order to provide much-needed context in response to media reports about an Institutional Crisis Intervention Team (ICIT) deployment at Maplehurst Correctional Complex following an unprovoked, severe assault on a correctional officer in December 2023.

    The assault on the correctional officer took place in an overcrowded, understaffed general population maximum security unit, where inmates charged with the most violent offences and gang-related charges are held on remand. After the assault, a comprehensive threat assessment was completed as per usual practice.

    “As union representatives, we often see Ministry management fail to take assaults and threats against correctional workers seriously,” said Chad Oldfield, Chair of OPSEU/SEFPO’s Correctional Bargaining Unit. “But in this case, after the threat assessment, it was clear that there was a serious, credible, and ongoing threat against correctional staff. That’s why a comprehensive search by the ICIT was ordered and approved by senior managers to be carried out across the unit.”

    High threat level searches by ICIT are rarely used, and require stringent oversight from senior management. Ontario regulations authorize the use of force in certain circumstances, including conducting searches and maintaining order within an institution.

    “ICIT members are correctional officers with specialized training to carry out tactical operations under the most dangerous, volatile and violent conditions,” said Oldfield. “Any operation they undertake is meticulously planned and approved. It’s then directed and overseen by senior management every step of the way. Our ICIT members across the province carry out their specialized duties professionally and according to approved plans.”

    Oldfield rejected the negative characterizations of the December 2023 ICIT deployment at Maplehurst reported in recent media stories. “The inflammatory language used to describe these operations shows total disrespect for correctional workers who risk their lives every day keeping communities across Ontario safe,” he said. “ICIT operations are not used as a form of punishment or retribution. They are used to maintain order and safety within the institutions.”

    There is a current, ongoing investigation of the operation in question at Maplehurst by the Ministry of the Solicitor General. OPSEU/SEFPO correctional workers are cooperating with the investigation, with full support and representation from their union.

    “You can’t just rely on inmate accounts to assess the security level and threat posed to staff and inmates inside of a correctional institution,” said Oldfield. “That just doesn’t make sense, especially when violence perpetuated by inmates continues to rise within correctional institutions.”

    Violence against correctional staff remains largely unchecked. In 2023, there were more than 1,800 incidents of workplace violence from inmates directed toward correctional staff, and more than 950 of those were assaults.

    “That’s more than two assaults per day – it’s the highest number of assaults against staff that we’ve ever seen,” said Oldfield. “Where is the outrage over the violence experienced by our members on a daily basis?”

    Oldfield also questioned the lack of response from the senior management within the Ministry of the Solicitor General. “Why have they stayed largely silent in the face of this one-sided narrative instead of defending their employees? The media is quick to blame frontline staff for the dysfunctional system rather than decision makers that refuse to provide the resources needed to operate institutions safely.”

    OPSEU/SEFPO President JP Hornick called out the Ontario government for their lack of investment to fix the impossible working conditions and inhumane living conditions inside Ontario’s correctional institutions.

    “Correctional workers face some of the toughest working conditions in the province,” said Hornick. “They come in every day to over-crowded, understaffed institutions with crumbling infrastructure and lack of proper programming and mental health supports for inmates. OPSEU/SEFPO and our Correctional Bargaining Unit leaders and members have been raising these issues for years. And yet, successive governments refuse to fix these dangerous conditions that explode regularly into violence, medical emergencies, injuries and deaths at institutions across Ontario.”

    “The Ford government can step up and support correctional workers by fixing Ontario’s broken correctional system,” Hornick concluded.

    Delegate Entitlement

    (as set out in 18.13 – CAAT(S) Part-time Negotiations Procedure)

    2.2 Only members from the College Support Part-Time unit are entitled to be delegates. Where neither the Local President nor Vice-President of a local is from the College Support Part-Time unit, the automatic first delegate shall be the Highest-Ranking College Support Steward elected, and should no officers exist, then the LEC will hold an election to determine the ranking.
    Each local of the Division shall elect unit delegates in accordance with Article 13.4(a) of the Constitution.

    a) The Highest-Ranking Steward or Officer of the Unit (or in their absence, the next Highest-Ranking Steward or Officer) shall be the automatic first delegate. All other delegates shall be elected by a clear majority of the members voting at a general membership meeting of the unit.

    b) If there is no Part-Time member elected as a delegate, the Full-Time College Support President or Vice-President of the local may attend with voice but no voting delegate status. They shall attend for the purpose of sharing information.

    Delegates shall be responsible for representing their local during the entire bargaining process including responsibility for reading, reviewing, summarizing and communicating bargaining information at the local level.

    2.3 Each local shall also elect alternates up to the number of delegates to which it is entitled and may send observers up to the number of delegates to which it is entitled. Attendance by alternates/observers at the Pre-Bargaining Conference shall be at the expense of their local, except where an alternate is replacing a delegate who is unable to attend.     Set your Local Demands for bargaining:

    The only proposals that will be considered official are those that are adopted by the majority vote of the local membership. Minutes of the meeting along with proposals adopted should be sent directly to Negotiator, Andrew Ruszczak, by email at aruszczak@opseu.org

    Delegate Entitlement

    As per Articles 2.4, 2.5 and 2.6 of the Negotiating Procedures; Delegates and Alternates attend the Final Demand Set meeting, as follows:

    2.4 Each Regional Lab as defined in the final demand setting and bargaining team elections process shall be entitled to elect one delegate and one alternate to the final demand setting meeting.

    2.5 The Central Lab as defined in the final demand setting and bargaining team elections process shall be entitled to elect three delegates and three alternates to the final demand setting meeting.

    2.6 Alternate expenses are the responsibility of the Local.

    3) Final Demand Set Meeting:

    The Final Demand set meeting will prioritize demands and review the results of the Individual Demand survey. The bargaining team will be elected to negotiate the new collective agreement.

    The bargaining team shall be elected as follows:

    • Two (2) members from Central, One (1) Technologist and One (1) Lab Attendant;
    • Two (2) members from Regional labs without regard to their job title;
    • One (1) Non-Technical between Central and 480 University Ave Toronto

    Collective bargaining works best when your elected bargaining team knows exactly what the members need and want; the Demand Setting process is how this information is gathered. As the elected person in your Unit, it is your responsibility to ensure that this process is completed.

    The Job Classification Committee (JCC) is pleased to announce a three-day virtual training session for interested Stewards who would like to learn about the CAAT-S Job Evaluation System. This training is geared towards stewards who represent members on classification grievances. At the end of the training, participants will be able to assist CAAT-S Full-Time members to navigate through the job evaluation process.

    Participants must attend all three days in order to successfully complete both modules (Classification Grievances & Preparing for Expedited Arbitration). Descriptions of the workshops are provided below.

    Registration will be on a first come, first registered basis to a maximum of 20 participants.

    CAAT-S Job Evaluation Training 2024

    Module 1 – Classification Grievances

    This introductory module will help participants gain a better understanding of how their classification system works, including the process for reviewing Position Description Forms (PDFs), performing job evaluations and the filing of classification grievances. Participants will gain comfort in using the Job Evaluation Manual, Quick Arbitration Manual, Evaluators Handbook and the Guide on How to Write Support Staff PDFs. The module will focus on developing practical skills in interviewing a potential grievor, evaluating Support Staff positions, and knowing how to prepare for and present at a Step One grievance meeting.

    Module 2 – Preparing for Expedited Arbitration

    In this advanced module, participants will develop a solid understanding of how their job evaluation system works including the Step Two grievance meeting, preparation of the Arbitration Brief and the Expedited arbitration. By the end of the module participants will have a firm understanding of how the job evaluation system works including how to prepare for and present at a Step Two grievance meeting and expedited arbitration hearings.

    Ford government deadly closure of safe consumption sites spells disaster for Ontario’s overdose epidemic: “Safe supply saves lives – this decision will result in countless unnecessary deaths.”

    FOR IMMEDIATE RELEASE

    Toronto, ON – In a stunning display of contempt for real community safety, the Ford government announced yesterday the closure of ten safe consumption sites (SCS) across Ontario that provide life-saving services, including overdose prevention, in Guelph, Kitchener, Hamilton, Thunder Bay, and Toronto.

    Even as frontline workers at these community pillars fight to glean more information from the province regarding potential lay-offs, it is the tens of thousands of lives lost to a province-wide drug poisoning epidemic that are front of mind. This violent directive will lead to countless preventable deaths.

    The announcement came on behalf of the Ford government from Minister Sylvia Jones at the Association of Municipalities of Ontario (AMO) in Ottawa, leveraging new zoning legislature that will lead to SCS closures across the province.

    “Safe supply saves lives – this decision will result in countless unnecessary deaths,” said Kirsty Millwood, President of OPSEU/SEFPO Local 5115, a composite local representing workers at Regent Park Community Health Centre, one site named in the announcement. “It is unconscionable to cut life-saving services in the midst of a health care crisis that has taken over 45,000 lives across the country in the last decade, and thousands more in the last year alone.”

    “Closing safe consumption sites will not make substances disappear from our communities,” added Millwood. “But it will leave people more likely to use alone and overdose during a worsening toxic drug poisoning epidemic.”

    The announced closures come only months after 51 community groups – including leading harm reduction, community health care, and drug policy organizations – called upon Ford’s government to immediately fund and support supervised consumption services amidst the worsening toxic drug crisis.

    Yesterday’s decision to package the announcement of closures of safe consumption sites along with the introduction of “Homelessness and Addiction Recovery Treatment (HART) Hubs” fundamentally misunderstands the nature of support offered at safe consumption sites – what workers champion as the “gateway to appropriate health care.”

    “These ‘treatment hubs’ are a failed attempt to reinvent the wheel – sites with Consumption and Treatment Services (CTS) already integrate holistic support for substance users and connect people with showers, treatment referrals, counselling, and more,” said Tannice Fletcher-Stackhouse, a nurse practitioner and President of OPSEU/SEFPO Local 744, representing over 130 frontline workers at NorWest Community Health Centre in Thunder Bay. “We’ve diverted hundreds of patients away from already over-loaded emergency rooms that are unequipped to provide the comprehensive, destigmatized, longer-term care we provide in-house.”

    Fletcher-Stackhouse says that staff at her local NorWest Community Health Centre – another affected site – that come to this work through lived experience are bracing for impact, anticipating the deaths that will fall on the province’s hands.

    “What these new facilities will do is further fragment care and make it harder for people to get the specific support they need, when they need it,” added Fletcher-Stackhouse. “Our detox beds are chronically full – yet all of a sudden, we’re going to have 19 new hubs up and running by March 2025 that can meet service user needs? This is an expensive mistake that will cost the province in millions of dollars and countless, preventable deaths.”

    A recent study published earlier this year found a substantive 67 per cent reduction in overdose deaths in Toronto neighbourhoods within 500 meters of supervised consumption sites after their opening.

    “Harm reduction workers have been on the frontline of this crisis for years – and we’ve seen firsthand that where the provincial government has failed to enact lasting solutions, our work in safe consumption sites has made a profound difference,” said Millwood. “To see the province now weaponize the language of ‘public safety’ while disregarding subject experts in harm reduction, drug policy, and health care through such a deadly policy directive is indefensible.”

    “Community hubs with overdose prevention on-site are being framed by Conservative politicians as a ‘safety’ issue – but whose safety is really being weighed when we say that?” asked JP Hornick, President of OPSEU/SEFPO. “Are we considering the 7,444 lives saved at provincially funded supervised consumption sites since 2017?”

    “These are empirically-driven health interventions proven to save lives,” added Hornick. “We are grieving too many names to be making anti-science policy decisions which add to that list – and there is no universe in which shuttering safe consumption sites does not lead to that list growing.”

The three-week notice will ensure adequate time to process advances when requested. If members then bring children to the event without the required notice, the member should be responsible for making his/her own child care arrangements.

    Joint Statement: Workers Ask the Premier to Base Public Policy on Evidence and Continue Saving Lives

    August 20, 2024

    The following is a joint statement from SEIU Healthcare, CUPE Local 79, CUPE Ontario, OPSEU/SEFPO, ONA, and UFCW Locals 175 & 633.

    Every Ontarian deserves low-barrier access to mental health and addictions services in their community. These services must include life-saving harm reduction spaces that are well-funded and professionally administered and allow for the safe consumption and treatment in places across the province where the need is greatest serving the most vulnerable and marginalized. Currently there are 17 provincially funded sites across Ontario, but there is clear and evident need for more in communities across the province.

    As representatives of workers, community nurses and health-care professionals, and health care providers at consumption treatment and safe injection sites, we strongly condemn today’s announcement from the provincial government.

    Premier Ford’s decision to close certain life-saving supervised drug consumption facilities will cost lives and hurt communities. It will also lead to increasing the burden on already stretched Emergency Medical Services and on our ERs and hospitals.

    Safe injection sites were born out of necessity, organized without a legal framework by community advocates who bravely acted to save lives. We must not go back to a time when the opioid crisis is allowed to grow under the veil of ignorance and stigma. In fact, one person in Ontario dies every 2.5 hours due to toxic unregulated drugs (source). We cannot abandon these human beings.

    Public policy should be evidence-based, and all of the research shows that safe consumption and treatment sites save lives. Instead, Ontario is making policy based on the Premier’s reaction to his federal Conservative leader. This is not defensible.

    For these reasons, we call on the provincial government urgently to speak with people with lived experience, researchers, service providers and the front-line workers who are best placed to provide input on how to improve consumption and treatment services and on how best to integrate them into other mental health and support services. It is critical to maintain and increase funding and exemptions to all currently operated sites.

    Our members and our organizations save lives every day; policy announcements like these will do the opposite.
