    Qualifications:

    Event dates: Oct. 21 – 25, 2024

    Application deadline: Monday, Aug. 26, 2024

    After the grievance procedure has been exhausted, an unresolved grievance can be referred to the last stage to be decided at Arbitration.  This Course is intended to inform Local Union activists regarding various elements of the process at an Arbitration Hearing in order to fully appreciate what occurs during the grievance procedure and how it affects the final outcome.

    Those selected for this Course will engage in a mixture of lecture-style review as well as role-play exercises.  All the basic elements of what happens at a Hearing will be reviewed.  It will culminate with a mock arbitration in which you will prepare and present portions of a case in front of an arbitrator with your team.

    This Course is intended for Local Union Officers and Stewards who have:

    • taken Grievance Handling 1 & 2, (and/or Stewards 1, 2 & 3); and
    • have extensive grievance handling experience up to the final stages of the grievance procedure.
    • have previously attended Arbitration Hearings and/or Mediation would be an asset.

    Negotiations remain ongoing with the employer and under the Crown Employees Collective Bargaining Act (CECBA) OPSEU/SEFPO members in the Ontario Public Service (OPS) have the legal right to strike. However, during this process it also requires OPS Unified to provide essential and emergency services during a strike or employer lockout.’

    Distinction between EES Form and EESA?

    Essential and Emergency Services (EES) are services necessary for the safety and/or security of the public. EES Forms are documents completed by locals to assist the Bargaining Team in negotiating the Agreements.

    Essential and Emergency Services Agreements (EESAs) are any signed documents negotiated between the union and employer to provide the above services.

    Doesn’t the union already have the Essential and Emergency Service Agreements (EESA’s) from previous rounds of bargaining?

    All previous agreements are null and void and therefore new ones need to be negotiated.

    Who decides what duties and which members will be essential?

    Your Bargaining Team and the employer negotiate essential services in accordance with CECBA.

    “Essential services” means services that are necessary to enable the employer to prevent,

    1. danger to life, health or safety,
    2. the destruction or serious deterioration of machinery, equipment or premises,
    3. serious environmental damage, or
    4. disruption of the administration of the courts or of legislative drafting; (“services essentiels”)

    An “Essential services agreement” is an agreement between the employer and trade union that applies during a strike or lock-out and that has,

    1. an essential services part that provides for the use, during a strike or lock-out, of employees in the bargaining unit to provide essential services, and
    2. an emergency services part that provides for the use, during a strike or lock-out, of employees in the bargaining unit, in addition to those referred to in clause (a), in emergencies. (“entente sur les services essentiels”) 1993, c. 38, s. 30.

    OPSEU/SEFPO’s Provincial Young Workers Committee will be hosting the annual Young Workers Conference. This year’s event titled, “Learning to Fight in a World on Fire: Empowering Young Workers to Fight for Climate Action” reflects the urgent need for young workers to address the climate crisis. As we navigate a world engulfed in environmental challenges, we are eager to hear from guest speakers about the struggles faced within Canada and the drastic steps needed to mitigate climate destruction. Through workshops and discussion, we aim to explore the essential social, political, and economic changes required to combat the climate crisis, particularly from the perspective of young workers within the labour movement. Furthermore, we seek to understand how reconciliation can be integrated into this fight, potentially necessitating a shift in worldview.

    Hotel Room Bookings

    OPSEU/SEFPO will make the hotel reservation on behalf of the member when they request a hotel room while registering through the Member Portal. Please note that the 60 km rule has been waived for this event. OPSEU/SEFPO will be booking all hotel rooms centrally. Hotel rooms will be reimbursed on a single room basis.

    Members are responsible for payment of their hotel room upon check out as there are no charges billed back to OPSEU/SEFPO. Please save your itemized receipt (showing a zero balance) and submit it with your Membership Expense Claim Form.

    The single room rate is $199.00 plus taxes per night.

    You must notify the hotel of any special accessibility needs that you may have with respect to your hotel room.
    Any additional nights outside of this policy must be pre-approved by the First Vice-President/Treasurer’s office, regardless of Region or distance from the event.

    Human Rights Accommodation Request Form

    Should you require a human rights accommodation or have an existing accommodation under the Human Rights Code, please complete and submit the Human Rights Accommodation Request Form in full. Family, Dependent and Attendant Care are covered expenses for this event for those who require it at the event or at home.

    Meals

    Meals will be covered on these dates:
    1) Travel days for those staying at the hotel and who live beyond 60km from the event.
    2) Friday, October 25, 2024: Dinner
    3) Saturday, October 26, 2024: Breakfast, Lunch and Dinner
    4) Sunday, October 27, 2024: Breakfast and Lunch

    OPSEU/SEFPO Child Care Policy

    OPSEU/SEFPO undertakes to provide childcare services, when requested, at all union educationals, conventions, regional, divisional and demand-setting meetings where the membership requests at least three weeks prior to the event. Members who bring their children to OPSEU/SEFPO sponsored functions should normally be required to use the on-site child care service if it is available. The three-week notice will ensure adequate time to process advances when requested. If no requests for on-site child care are received three weeks prior to the activity date, childcare arrangements for on-site child care may not be made. If members then bring children to the event without the required notice, the member should be responsible for making his/her own child care arrangements.

    Course descriptions

    Challenging Discrimination in Everyday Union Work

    This course looks at everyday situations in our workplaces and union where inequality and racism are at work, and where people can take effective action. It uses case scenarios and analysis to examine different forms of discrimination – race, gender, age and disability – and its divisive effects. It draws from videos and role play to get people to practice responding practically to situations.

    The course helps us to see equity and human rights as basic union work for all. And it strengthens our skills as effective allies and advocates to build more inclusive workplaces and locals.

    Cross-Cultural Communication at Work: A Union Perspective

    In our workplaces, unions, and communities, we experience daily interactions with diverse groups including co-workers, and our union sisters and brothers. There are moments when these interactions lead to miscommunication, and misunderstanding about cultural expressions and social cues. In order to work through some of these communication challenges, an introductory course, Cross-Cultural Communication has been designed.

    Participants will work through case scenarios to develop strategies designed to improve cross-cultural communication.

    Interpreting Your Collective Agreement: An Activist’s Role

    Do you know what your collective agreement is? Do you have a copy of it? Have you ever wondered what is in your collective agreement and how to find information on different articles? Do you know how the collective agreement is structured? Are you confused by some of the terms used in it?

    Participants will be assisted in understanding the power of their collective agreement and how to interpret and enforce their collective agreement. Using interpretation guidelines developed through case law, participants will build the skills and confidence needed to understand and use their collective agreements.

    Activities will give participants an opportunity to review legislation, examine the importance of timelines, discuss case scenarios and debate some common clauses and what they mean. Participants should bring their Collective Agreements to the course.

    Stewards 2: Facing the Employer, Building Member Involvement

    Prerequisite: Stewards 1

    This follow-up to Stewards 1 focuses on investigating and writing a grievance, facing management, and involving members in worksite action. Participants will use their own collective agreements to identify grievances. They will become immersed in a case study in order to interview a grievor, write up a grievance, face the employer at a step 1 and make a presentation on safety issues to the union side of the Joint Health and Safety Committee. They will examine the elements of effective mobilization and develop a campaign strategy for a local. Participants should bring their collective agreements.

    Local Treasurers Course

    This course is aimed at Local Treasurers and Trustees who are either NEW to the role or experienced members who are seeking a “refresher course”. The goal is to give the necessary tools and education to Local Treasurers and Trustees in order for them to fulfill their roles in the Local. It will also draw on members’ experiences to solve problems occurring with the administration of Local funds.

    Applications

    Completed application forms must include the signed recommendation or an approval email from a Local Executive Officer and be received by the Thunder Bay Regional Office no later than September 6, 2024. Please note applications will not be accepted after this date.

    Selection process – Education Policy Section 7 (Policy Manual)

    The selection process will be in accordance with the Education Policy – Section 7 of the Policy Manual. All Local Presidents have an OPSEU/SEFPO Policy Manual. Please contact your Local President to review this policy. Applicants will be notified after September 11, 2024 of their acceptance for the educational.

    Cancellations

    Notification by a member to cancel course attendance should be received by both the local president and the regional office no later than 48 hours before commencement of the regional school (no later than 4:30 P.M. on the Wednesday prior to the weekend school). When a member does not attend and the Regional office has not been notified 48 hours prior to the school’s commencement, the member will be assessed a $50.00 penalty. Extenuating circumstances will be taken into consideration.

    Family/Attendant Care

    Family/Attendant Care will be reimbursed as per OPSEU/SEFPO policy as outlined on the back of the expense claim. If you have any questions, please check the OPSEU/SEFPO Policy Manual.

    Members seeking childcare onsite must make their request through the Thunder Bay Regional Office by September 6, 2024.

    Lost wages / time off

    Per past practice, lost wages will be paid for those members who are shift workers and are scheduled to work on Friday, November 8 and/or Saturday, November 9 and/or Sunday, November 10. Any claim for lost wages must be substantiated by proof from your employer.

    Travel time

    Lost wage claims will also be accepted for those members who are not shift workers and who have to take time off to travel to the educational. Claims will only be honoured for the time that is required to travel.

    Hotel and meals

    Accommodation will be provided for those members who must travel 60 kilometres or more. Reservations may be made by contacting the Valhalla at (807) 577-1121 Please tell them you are booking with OPSEU or block # 1255589.

    Members who bring children to the Educational will be entitled to single accommodation. The meal allowance for children under 13 years of age should be 50% of OPSEU/SEFPO’s standard meal allowance. If you require special assistance at the hotel, please notify the hotel at the time of making your reservations.

    Lunch will be provided on Saturday. If you have any food allergies or special dietary requirements please ensure a Human Rights Accommodation Request Form is submitted.

    a) Political Action Committee – whose role will be working with our union lobby government, mobilizing, educating and empowering the membership on issues of   healthcare, long term care, home care, pharmacare, pensions, affordable housing and other issues that affect our membership.

    b) There’s no Planet B Committee – will advise the membership on how they can make a difference protecting our planet from being polluted and climate change. Responsibilities include recommending speakers, planning an activity/event.

    c) Social Justice Committee – inform and mobilize the membership regarding issues of social justice, poverty, homelessness etc. Will include coordinating the volunteering at the RFDA.

    d) Social Committee – Social Committee that will organize social activities outside our two regional meetings a year. Coffee Cards and Conversation will be part of this committee’s work as well as sharing activities for seniors in our communities.

    e) Flying Picket Squad – selected group of members that are interested in supporting all OPS locals with demonstrations, strike lines etc. The chair/vice chair will access this list as requested.
